Terms of Service

1. Acceptance

MotionCreate is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS]. Creating an account, buying credits or using the service means you accept these terms. If you are using MotionCreate for an organisation, you confirm you may accept them on its behalf.

2. Eligibility and your account

You must be old enough to enter a binding contract where you live. Give accurate account details, keep your credentials to yourself, and tell us promptly if you believe your account has been used without your permission. Activity under your account is your responsibility. One person or organisation per account; do not share logins.

3. What the service does

MotionCreate turns product images you supply into commercial product photography — clean product shots and campaign imagery, optionally including a generated model — using third-party AI image-generation providers. Output is produced by a generative model. Results vary between runs, and we do not warrant that any particular image will match a specific expectation.

4. Credits

MotionCreate credits are the unit of account for generation. They are a prepaid balance for use inside MotionCreate only: they are not money, not a stored-value instrument, and cannot be transferred between accounts or exchanged for cash. New accounts receive a one-time free grant. Credits bought as part of a plan do not expire.

Credits are deducted per image at the resolution you choose. Current rates are shown on the pricing section of our site and in the studio before you generate. We may change rates for future generations; a run already charged is not repriced.

5. Plans, purchases and taxes

Plans are one-time credit purchases, not recurring subscriptions, and nothing renews automatically unless we say so at the point of purchase. Prices are shown in Indian Rupees and are charged through our payment gateway. Whether displayed prices are inclusive or exclusive of applicable taxes is [TAX TREATMENT — to be confirmed]; any tax invoice we are required to issue will be issued by [LEGAL ENTITY NAME].

The price and credit amount charged are always the ones recorded in our system for that plan at the time of purchase.

6. Acceptable use

You agree not to use MotionCreate to:

• upload images you do not own or have permission to use, including another brand’s product photography;
• create imagery of a real identifiable person without their consent, or that impersonates a real individual or brand;
• produce sexual content involving minors, or any content that sexualises a minor, in any circumstance;
• produce content that is unlawful, defamatory, harassing, hateful, or that incites violence;
• create misleading imagery that misrepresents a product’s material characteristics for the purpose of deceiving buyers;
• infringe intellectual property, breach applicable advertising or consumer-protection rules, or violate the terms of the AI providers behind the service;
• probe, overload or circumvent the service, its rate limits, its credit accounting, or attempt to access another account’s data.

We may remove content and suspend or close accounts that breach this section.

7. Your content

You keep ownership of the product images and other material you upload. You grant us a licence to store, process, transmit to our AI providers and display that material solely in order to operate the service for you. You confirm you hold the rights necessary to grant that licence.

8. Generated images

As between you and us, and once the credits for a generation have been charged, you may use the images the service produces for you commercially — including on product pages, marketplaces, campaigns, catalogues and social content.

We do not warrant that generated output is free of third-party rights, or that it is registrable or protectable as your own intellectual property. The legal status of AI-generated works differs between jurisdictions and is still developing. Your use of output is also subject to the terms of the AI providers used to produce it. Generated output may resemble output produced for other users, and we do not grant exclusivity in any image, style or composition.

9. Third-party providers

MotionCreate depends on third-party AI generation, hosting, storage, authentication and payment providers. Their availability and their terms affect the service, and an outage or policy change at a provider may interrupt or alter what MotionCreate can do.

10. Availability

We aim to keep MotionCreate available but do not promise uninterrupted service, and we give no uptime guarantee. Features may be added, changed or withdrawn. Where a generation fails for a technical reason on our side, we aim to restore the credits it consumed — see the Refund & Cancellation Policy.

11. Suspension and termination

You may stop using MotionCreate at any time and ask us to close your account. We may suspend or close an account that breaches these terms, that is used unlawfully, or where we are required to do so. Where we close an account for a reason other than a breach by you, we will deal with any unused paid credits as described in the Refund & Cancellation Policy.

12. Refunds

Purchases and refunds are governed by our Refund & Cancellation Policy, which forms part of these terms.

13. Disclaimers and liability

To the extent permitted by law, MotionCreate is provided “as is” and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect or consequential loss, loss of profit, loss of goodwill or loss of data. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

14. Changes to these terms

We may update these terms. The effective date above will change, and where an update is significant we will notify account holders. Continuing to use MotionCreate after an update means you accept it.

15. Governing law

These terms are governed by the laws of [GOVERNING JURISDICTION], and the courts of [GOVERNING JURISDICTION] have exclusive jurisdiction over any dispute arising from them.
